The EB-5 Immigrant Investor Program was created by Congress in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors. Under this program, investors and their immediate family members can obtain permanent residency in the United States by making a qualifying investment.

Understanding the Visa Bulletin
- Priority Date: The date USCIS receives your I-526 petition

What is the EB-5 Immigrant Investor Program?
The EB-5 program is a U.S. visa program created in 1990 that provides a pathway to permanent residency for foreign investors who make a qualifying investment in a U.S. business and create or preserve at least 10 full-time jobs for qualifying U.S. workers.
How much do I need to invest?
The standard minimum investment amount is $1,050,000. However, if you invest in a Targeted Employment Area (TEA), which is either a rural area or an area with high unemployment, the minimum investment amount is $800,000.
What is a Regional Center?
A Regional Center is an organization designated by USCIS that sponsors capital investment projects for EB-5 investors. Regional Centers can help investors meet the job creation requirements by counting both direct and indirect jobs created by the investment project.
Who can be included in my EB-5 application?
Your spouse and unmarried children under 21 years of age can be included as derivative beneficiaries on your EB-5 application. They will receive green cards along with you if your application is approved.
What is the difference between direct investment and Regional Center investment?
In a direct investment, you invest directly in a new commercial enterprise that you will manage day-to-day or through policy formulation. With a Regional Center investment, you invest in a project sponsored by a USCIS-approved Regional Center and typically take a more passive role.
What does "at risk" mean for my investment?
The "at risk" requirement means that there can be no guarantee of return of capital or a rate of return on your investment. Your investment must be subject to both gain and loss. Arrangements that protect against loss of capital or guarantee returns do not qualify as "at risk."
How long does the EB-5 process take?
Processing times vary significantly based on USCIS workload, your country of origin, and other factors. Currently, I-526 petitions take approximately 44-56 months to process. After I-526 approval, obtaining conditional permanent residency depends on visa availability for your country. Removal of conditions through the I-829 petition takes approximately 35-52 months.
What is conditional permanent residency?
Conditional permanent residency is a 2-year green card granted to EB-5 investors after their I-526 petition is approved and their visa/adjustment of status application is processed. During this period, USCIS verifies that the investment was sustained and the required jobs were created.
How do I remove the conditions on my green card?
You must file Form I-829, Petition by Entrepreneur to Remove Conditions, within the 90-day period before the 2-year anniversary of receiving your conditional green card. This petition demonstrates that you have fulfilled all EB-5 requirements, including sustaining your investment and creating the required jobs.
What happens if my I-526 petition is denied?
If your I-526 petition is denied, you may file a motion to reopen or reconsider with USCIS, or appeal the decision to the Administrative Appeals Office (AAO). The availability of investment funds return depends on the terms of your investment agreement with the project or Regional Center.

Form I-526, Immigrant Petition by Alien Entrepreneur, is used by foreign investors to petition USCIS for status as an immigrant to the United States under the EB-5 program. Below are key instructions for completing and filing this form.
General Instructions
- Type or print all answers in black ink.
- Answer all questions fully and accurately. If an item is not applicable, write "N/A."
- If you need extra space to complete any item, attach a separate sheet of paper.
- Sign and date your form. A stamped or typewritten name in place of a signature is not acceptable.
Filing Fee
The filing fee for Form I-526 is $3,675, plus an additional $85 biometric services fee if applicable. Fees are non-refundable regardless of the action taken on your petition.

Required Documentation
You must submit the following documentation with your Form I-526:

- If your petition is approved, you may proceed with applying for an immigrant visa or adjustment of status.
Important Note
As of March 15, 2022, investors filing based on an investment in a project associated with a USCIS-designated Regional Center should file Form I-526E instead of Form I-526.

Source of Funds Guidelines
One of the most critical aspects of an EB-5 petition is demonstrating that the investment capital was obtained through lawful means. USCIS requires comprehensive documentation tracing the path of funds from their origin to the investment in the EB-5 project.
General Requirements
- You must provide evidence that all capital was obtained through lawful means.
- Documentation must trace the path of funds from source to investment.
